The Rolling Stone reported that Allman appeared for a court hearing by video call on June 25. After his request to represent himself in his case, which Judge Jessica A. Uzcategui denied, she adjourned the hearing to Sept. 1. Allman is currently being held at a psychiatric facility in New Hampshire.A statement from the judge said, “In the court investigator’s report, Mr. Allman has expressed no intention of returning to California even after being released from the New Hampshire hospital,” while also disputing whether he even had jurisdiction to rule on the case.She added, “And I understand that he can be held in New Hampshire for up to a year and a half, and even then he would be returned to a New Hampshire correctional facility or a New Hampshire treatment facility. So, under all of these circumstances, it doesn’t appear to me that Mr. Allman will be back in California for much longer, if ever, and I questioned the court’s jurisdiction.”On the other hand, Cher’s lawyer, Justin Gold, stated that Los Angeles County is the right place for the case to take place. He added: “Mr. Allman’s stated preference is being made while he is incarcerated in a mental institution and lacks capacity,” he stated. “The only reason he’s in New Hampshire right now is because he can’t leave. And for him now to say, ‘Oh, I’m not going back to California,’ just to avoid jurisdiction here, that’s all. His whole life is here.” The judge has ordered Gold to first file a legal brief with the court on the matter by July 16.
This is not Cher’s first attempt to put her son under guardianship
In 2023, the actress filed a petition to put her son under guardianship at the time, believing that she was not fully capable of managing her finances. However, after Allman stated that he would change and that he was working on his health and well-being, his mother dropped the petition.
